§ 15.38.040. Application for permit.

  • Applications for a permit under this chapter shall be made to the city clerk and shall be:

    (1)

    Made in writing, accompanied by a tender of the permit tax;

    (2)

    Made after the second Tuesday in April of each year and before the last business day of May.

    (3)

    Description, by street address, of the proposed location of the fireworks stand for which the permit is requested;

    (4)

    Accompanied by, at least, a one million dollar general liability insurance policy, with the premium prepaid, for a term not less than the term of the permit, running to the protection of the city, its officers, agents and employees when acting in their official capacity as such, and covering liability for monetary damages resulting from an occurrence because of bodily injury, property damage or personal injury, including false arrest, libel, wrongful entry, discrimination and assault;

    (5)

    Each organization shall file at the time application is accepted certified statement of nonprofit status;

    (6)

    Accompanied by an assurance in writing that the applicant, if permitted, will neither sell nor purvey, nor suffer or permit any person to sell or purvey, at the location of the permittees fireworks stand any "dangerous fireworks," as defined in Section 12505 of the Health and Safety Code; and

    (7)

    Accompanied by a signed written approval of property owner that the firework booth shall be allowed on his property and including a business telephone number at which the property owner can be reached;

    (8)

    Include a designation of all nonprofit associations or corporations to which the applicant intends to distribute the net proceeds of its fireworks sales; and

    (9)

    The city clerk shall notify the applicant for any such permit of the granting or denial of that application on or before the first Monday in June.
